Guidelines for Open Burning for the City of Emporia (Only)


-Refer to Uniform Fire Code 1102.3 and the amendments.
-Not required to be inspected before burning.
-Owner assumes all responsibilities.
-Neighbor’s complaints are not a reason to discontinue burning unless a violation of the code is committed.

  • Fire department must be notified at 620-343-4230 before burning.
  • Leaves and landscape waste is the only material allowed to be burnt.
  • Can Burn only from 7:00 am to 7:00 p.m.
  • Wind speed must be below 15 mph.
  • Cannot burn within any commercial zone.
  • Must be 50 feet from a structure, unless in an approved trash burner built of brick, cement, stone or metal, located not less than fifteen (15) feet from any structure and constructed in a manner to securely confine burning material with all openings protected with steel netting of one-half inch mesh or with steel plate with no larger than one-half inch holes therein.
  • Shall not burn upon any street, sidewalk or alley open to traffic.
  • Garden hose or extinguishing equipment must be available.
  • Fire must be attended at all times.

The Emporia Fire Department can order the burning to immediately be discontinued.
